These Terms of Service ("Terms") form a binding agreement between Pulse Messages ("Pulse," "we," "us," or "our") and the business or individual ("Operator," "Customer," or "you") that registers an account to use the Pulse Messages platform.
By creating an account, subscribing to a plan, embedding the Pulse widget on a website, or otherwise accessing or using the Service, you agree to be bound by these Terms.
Pulse Messages is operated by Zen Banez, a registered service based in Tacloban City, Leyte, Philippines.
Note to Operators: These Terms apply to Operators. Visitors who interact with the Pulse widget on an Operator's website are not parties to these Terms; their relationship is governed by the Privacy Policy.
To create an Operator account, you must be at least 18 years of age, have the legal capacity to enter into binding contracts, and represent that you have authority if acting on behalf of a business entity. You are responsible for maintaining credentials security.
Operators acknowledge that the Service is intentionally engineered as a batch-processed Secure Queue system (operating on 2, 5, or 10-minute heartbeat cycles). The Service is not designed for real-time instant chat and must NEVER be used for emergency, time-critical, or life-safety situations (such as medical, fire, or crisis intervention).
Pulse offers monthly subscription tiers: Starter ($29/mo for 10,000 credits), Pro ($79/mo for 30,000 credits), and Elite ($149/mo for 60,000 credits). Credit overage packs are available at $20 per 10,000 credits. Unused credits reset to zero at each billing cycle. All billing is handled securely via Stripe and is non-refundable.
Workspaces support role-based permissions (Owner, Admin, Operator, Viewer) to protect billing configurations. Seat limits are: Starter (1 seat), Pro (5 seats), Elite (100 seats).
Pro and Elite plans may subscribe to Bring Your Own Agent (BYOA) ($20/mo) to hook external agents into the secure air-gapped Firestore pipeline, and Pulse Relationships to trigger sentiment and structured CRM data extraction.
Operators agree not to utilize Pulse for illegal practices, to bypass API thresholds, or to transmit malware. Deceptively masking AI responses as a real-time human chat operator is prohibited.
These Terms shall be governed exclusively by the laws of the Republic of the Philippines. Disputes will be sequentially resolved via direct negotiation, local mediation, or binding English arbitration in Tacloban City, Leyte, Philippines. This sequential conflict resolution methodology reflects a local Filipino disposition (Pakikisama) prioritizing mutual respect and dialogue over aggressive legal escalation.
